Mô tả

Cách thức thực hiện:

Bước 1: Chuẩn bị hồ sơ theo quy định của pháp luật.

Bước 2: Nộp hồ sơ:

1. Cơ quan, tổ chức, cá nhân nộp hồ sơ tại một trong ba trụ sở làm việc của Cục Quản lý xuất nhập cảnh - Bộ Công an:

a) 44-46 Trần Phú, Ba Đình, Hà Nội.

b) 254 Nguyễn Trãi, Q.1, TP Hồ Chí Minh.

c) 7 Trần Quý Cáp, TP Đà Nẵng

2. Cán bộ tiếp nhận hồ sơ kiểm tra tính pháp lý và nội dung hồ sơ:

+ Nếu đầy đủ, hợp lệ, thì nhận hồ sơ, in và trao giấy biên nhận, hẹn ngày trả kết quả.

+ Nếu hồ sơ chưa hợp lệ thì cán bộ tiếp nhận hồ sơ hướng dẫn người nộp bổ sung hồ sơ cho đầy đủ.

Thời gian nộp hồ sơ:

- Từ thứ 2 đến sáng thứ 7 hàng tuần (trừ ngày tết, ngày lễ và chủ nhật).

Bước 3: Nhận kết quả:

a) Người đến nhận kết quả đưa giấy biên nhận, giấy chứng minh nhân dân hoặc hộ chiếu cho cán bộ trả kết quả kiểm tra, đối chiếu, nếu có kết quả cấp thẻ tạm trú, thì yêu cầu nộp lệ phí sau đó ký nhận và trao thẻ tạm trú cho người đến nhận kết quả (kể cả không được giải quyết).

b) Thời gian trả kết quả:

Từ thứ 2 đến thứ 6 hàng tuần (trừ ngày tết, ngày lễ và thứ 7, chủ nhật).

- Thành phần, số lượng hồ sơ:

+ Thành phần hồ sơ:

a) Văn bản đề nghị cấp thẻ tạm trú (mẫu NA6 đối với cơ quan, tổ chức, NA7 đối với cá nhân);

b) Tờ khai đề nghị cấp thẻ tạm trú cho người nước ngoài (NA8)

c) Giấy tờ chứng minh thuộc diện xem xét cấp thẻ tạm trú là một trong các loại giấy tờ như: giấy phép lao động, giấy xác nhận là Trưởng Văn phòng đại diện, thành viên Hội đồng quản trị hoặc các giấy tờ khác có giá trị chứng minh đủ điều kiện cấp thẻ tạm trú;

đ) 02 ảnh cỡ 3x4 cm (01 ảnh dán vào tờ khai, 01 ảnh rời);

+ Số lượng hồ sơ: 01 (một) bộ.

- Thời hạn giải quyết: không quá 05 ngày làm việc kể từ khi nhận đủ hồ sơ.

- Đối tượng thực hiện thủ tục hành chính: cơ quan, tổ chức, công dân Việt Nam.

- Cơ quan thực hiện thủ tục hành chính: Cục Quản lý xuất nhập cảnh, Bộ Công an.

- Kết quả thực hiện thủ tục hành chính: thẻ tạm trú.

- Lệ phí (nếu có):

+ Thẻ tạm trú có giá trị 01 năm: 80 USD/1 thẻ

+ Thẻ tạm trú có giá trị trên 01 năm đến 2 năm: 100 USD/thẻ.

+ Thẻ tạm trú có giá trị trên 2 năm đến 3 năm: 120 USD/thẻ.

- Tên mẫu đơn, mẫu tờ khai (nếu có):

+ Công văn đề nghị cấp thẻ tạm trú (mẫu NA6 đối với cơ quan, tổ chức, NA7 đối với cá nhân);

+ Bản khai thông tin về người nước ngoài đề nghị cấp thẻ tạm trú (mẫu NA8);

- Yêu cầu, điều kiện thực hiện thủ tục hành chính (nếu có):

1. Cơ quan, tổ chức khi đề nghị cấp thẻ tạm trú cho người nước ngoài cần phải nộp hồ sơ chứng minh tư cách pháp nhân tại Cục Quản lý xuất nhập cảnh, Bộ Công an.

a) Giấy phép hoặc Quyết định của cơ quan có thẩm quyền về việc thành lập tổ chức (có công chứng);

b) Văn bản đăng ký hoạt động của tổ chức (có công chứng) do cơ quan có thẩm quyền của UBND tỉnh, thành phố trực thuộc Trung ương cấp;

c) Văn bản giới thiệu, con dấu, chữ ký của người đại diện theo pháp luật của tổ chức;

Việc nộp hồ sơ trên chỉ thực hiện một lần. Khi có thay đổi nội dung trong hồ sơ thì doanh nghiệp phải có văn bản thông báo cho Cục Quản lý Xuất nhập cảnh để bổ sung hồ sơ.

2. Người nước ngoài nhập cảnh có mục đích hoạt động phù hợp với quy định của pháp luật Việt Nam, và không thuộc diện “tạm hoãn xuất cảnh” quy định tại, thì được xem xét cấp thẻ tạm trú có giá trị từ 1 năm đến 3 năm. Trong những trường hợp sau đây thì không cấp thẻ tạm trú:

a) Đang bị truy cứu trách nhiệm hình sự hoặc đang là bị đơn trong các vụ tranh chấp dân sự, kinh tế, lao động;

b) Đang có nghĩa vụ thi hành bản án hình sự;

c) Đang có nghĩa vụ thi hành bản án dân sự, kinh tế;

d) Đang có nghĩa vụ chấp hành quyết định xử phạt vi phạm hành chính, nghĩa vụ nộp thuế và những nghĩa vụ khác về tài chính.

- Căn cứ pháp lý của thủ tục hành chính:

+ Luật Nhập cảnh, xuất cảnh, quá cảnh, cư trú của người nước ngoài tại Việt Nam (Luật số 47/2014/QH13, ngày 16/6/2014).

+ Thông tư số 04/2015/TT-BCA, ngày 05/01/2015 của Bộ Công an quy định mẫu giấy tờ liên quan đến việc nhập cảnh, xuất cảnh, cư trú của người nước ngoài tại Việt Nam.

+ Thông tư số 219/2016/TT-BTC ngày 10/11/2016 của Bộ Tài chính quy định chế độ thu, nộp, quản lý và sử dụng phí, lệ phí trong lĩnh vực xuất cảnh, nhập cảnh, quá cảnh và cư trú tại Việt Nam.

What is Vietnam Temporay Residence Card (TRC)?

According to the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam 2014, temporary residence card is a document issued by an immigration authority or a competent authority of the Ministry of Foreign Affairs, granted to foreigners who are allowed to reside for a certain period of time in Vietnam.

Why should you apply for Temporary Residence Card in Vietnam?

There are many benefits that holders of a Vietnam temporary residence card may have:

Foreigners who are granted temporary residence cards can buy apartments and in the near future may buy houses. At present, the Ministry of Construction is proposing that foreigners buy houses in Vietnam to resolve real estate issues.
Foreigners can stay in Vietnam for a period of time while their temporary residence card is still valid without having to leave Vietnam.
Foreigners save money due to not have to apply for visa extension many times and save the travel costs
Foreigners can carry out business procedures, get married… very conveniently.

Who can apply for a temporary residence card in Vietnam

The following people can apply for a temporary residence card in Vietnam:

A foreigner who has Vietnam work permit which is valid for at least 12 months at time of applying for the temporary residence card.
Foreigners who are members of diplomatic missions, consular offices, representative offices of international organizations affiliated to the United Nations, intergovernmental organizations in Vietnam and their spouses, children under 18 years of age, housemaids who are accompanied by the term of office, are granted temporary residence card with symbol NG3.
Foreigners who are granted with LV1, LV2, ĐT, NN1, NN2, DH, PV1, LD, TT visas are granted temporary residence cards with symbols similar to the visa symbols. The Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam 2014 has defined new types of symbols and duration of each type of visa symbols for foreigners in Vietnam.Requirements and conditions for temporary residence card
Foreigners must temporarily stay for 1 year or more in Vietnam
The passport is valid for at least 13 months.
Required Documents for Applying for Vietnam Temporary Residence Card
A written request for issuance of temporary residence card for the foreigner by the guarantor (Form NA6 for agencies, organizations; Form NA7 for individuals)
Information form for temporary residence card attached with photo 3cm x 4cm (Form NA8)
Copy of passport and a valid visa (bring an original for comparison);
02 3*4cm photos (01 one to attach to the Information form, 01 one is kept separately)
Depending on the circumstances, one of the following is required:
01 copy of Business Registration Certificate of the legal entity of guaranteeing agency, organization, or enterprise.
Work permit or work permit exemption certificate;
If applying for a temporary residence card in Vietnam without work permit:
Investment certificate
License for establishment of representative office, branch of the company
Certificate of a member of the Board of Directors
Birth certificate, marriage certificate, family register… if applying for temporary residence card for husband, wife, child… who are foreigners
Proof of temporary residence declaration or Certification of temporary residence in the locality with the seal of the Commune Police
Note: Consular legalization and notarized translation into Vietnamese are necessary for all documents in a foreign language.
How to Get a Temporary Residence Card for Foreigners in Vietnam
Here come the steps to get a Vietnam temporary residence card of foreigners:
Step 1: Prepare documents as prescribed by law.
Step 2: Submit the documents
The agencies, organizations and individuals submit the application documents at one of the three working offices of the Immigration Department – Ministry of Public Security:
44-46 Tran Phu, Ba Dinh, Hanoi.
254 Nguyen Trai, District 1, Ho Chi Minh City.
7 Tran Quy Cap, Da Nang City
Time for submission: Mornings, Monday to Saturday (except public holidays).
Officials receiving dossiers will then examine the legality and content of the documents:
If the documents are complete and valid, the official will print and give a receipt of an appointment to get the
If the documents are not yet enough, the official will instruct the applicant to complete the application.
Step 3: Get the results.
The person who receives the results gives the receipt, identity card or passport to the officials who return the results for examination and comparison. If there are results of the temporary residence card, the official requests the applicant to pay fees and hand over the temporary residence card.
Time to get results: From Monday to Friday (except for public holidays).

Vietnam Temporary Residence Card Processing Time & Fees
The processing time of a request for a temporary residence card for foreigners in Vietnam is 05 working days from the date of receiving full documents.
According to Circular No. 219/2016/TT-BTC dated November 10, 2016 of the Minister of Health, the cost of a Vietnam temporary residence card at the Vietnam Immigration Department is:
US $145/card valid for up to 2 years
US $155/card valid for over 2 years to up to 5 years
Validity of Temporary Residence Card
The validity of the temporary residence card in Vietnam is at least 30 days shorter than the remaining duration of the passport.
The temporary residence cards with the symbol ĐT1 are valid for no more than 10 years.
The temporary residence cards with the symbols NG3, LV1, LV2, LS, ĐT2 and DH are valid for no more than 05 years
The temporary residence cards with symbols NN1, NN2, ĐT3 and TT are valid for not more than 03 years.
The temporary residence cards with symbols LĐ1, LĐ2 and PV1 are valid for no more than 02 years.
Expired temporary resident cards are considered for issuing new ones.
How to Change my Vietnam Temporary Residence Card

Foreigners are granted a new passport in which the new passport number is different from the passport number indicated on the temporary residence card;
Agencies responsible for changing temporary residence card for foreigners
Depend on each case, the foreigners may apply for a temporary residence card replacement at one of the following agencies of Vietnam:
Administration of Immigration
Department of Immigration Management of Police Departments of provinces and cities
The validity of the renewed temporary residence card
The renewed temporary residence card duration will be equal to the period written on the previously issued temporary residence card.

Passport of foreigners must be valid for at least 06 months;
Work permits (Investors, project managers, non-governmental organizations, foreign lawyers licensed to practice in Vietnam are not required to apply for a work permit)

How to Extend Vietnam Temporary Residence Card
Foreigners can extend their temporary residence card in Vietnam upon its expiry by:
Preparing the following documents:
Application form for visa issuance, stay extension (Form NA5)
Passport
Following the same procedure to get a new temporary residence card as mentioned above.
The Vietnam temporary residence card extension fee is US $10 and processing time is 5 working days after receiving full documents.
What to Do if I Lost my Vietnam Temporary Residence Card
The first thing foreigners should do is go to the local police to report the loss of that residence card. Local police will then confirm this notice to foreigners.
After this confirmation, foreigners can renew a new residence card in Vietnam. Why do you have to do it again? Because foreigners who want to exit Vietnam, must have a visa or a valid residence card, otherwise will be denied and not allowed to exit.
The procedure for re-issue of a lost temporary resident card is as follows:
Written requests of inviting or guaranteeing agencies, organizations and individuals;
01 declaration of information about the foreigner applying for temporary residence, with photo and stamp of the agency or organization;
02 photos sized 3 x 4 cm;
01 copy of passport, valid visa, entry and exit certificate (with the original for comparison);
01 copy (with the original for comparison) of documents proving the purpose of staying in Vietnam (depending on specific cases, submitting appropriate papers: investment license, enterprise establishment permit, work permit, certificate of board member, license to establish a representative office, certificate of marriage or birth …).
In case of loss of temporary residence card, in addition to the provisions of the new application dossier, an application must be submitted together with a written description of the reason for the loss or a written loss notice of the guaranteeing agency.
Processing time: Within 15 working days from the date of receiving full documents.
